This agreement is between “You” our client, as it will be defined below and Subhida UK Ltd. Trading as IME London (company No. 6432399), accompany incorporated under the laws of England and Wales whose registered office is at Pentax house , Southhill Avenue , South Harrow , London , HA2 0DU (“IME London”)
1. Definitions and meanings:
1.1. "IME London website(s)" means any URL, such as www.imelondon.co.uk owned and operated by IME London that we use to provide the Services to you.
1.2. “Business Days” means every official working day of the week (other than and Saturday or Sunday) on which Banks in England are open for business.
1.3. “IME London Services” shall mean the e-money Account opened and managed through the IME London website.
1.4. “Terms and Conditions” means this agreement including all subsequent amendments.
1.5. “Fees” means those amounts stated in “IME London Fees” section of these Terms and Conditions.
1.6. “Customer Service” means our customer service, which can be reached by email hrough the email address email@example.com or by calling +44 02088660307;
2. IME London overview:
2.1. IME London is a Payment Service Provider, its services are operated by Subhida Uk Ltd registered with Financial Conduct Authority (FCA)under the Payment Services Regulations 2017, for the provision of payment services.
3. About these Terms and Conditions
3.1. These Terms and Conditions regulate the opening, use and closure of IME London Servicess -whether face to face , on line, telephone or any other and all the payment services offered by IME London.
3.2. IME London is also subject to the Payment Services Regulations 2017 (the Regulations) which regulate how payments must be transmitted and provide protection when you send money to an account within the European Economic Area (EEA) and the payment is in Euros, Sterling or another EEA-State currency.
4. IME Londonservice overview
4.1. IME London services are Money Transmission services and ancillary foreign exchange. AnIME London service is not an Account of any type, but solely a method for you to access money transmission services therefore the UK Financial Compensation Scheme does not apply to the IME London Services.
4.2. IME Londonservices have limits which have been set up in accordance with the type of information and verification process used to on board you as a client; limits may vary and we may need to ask you for more information and/or documents
5. IME London Services opening:
5.1. IME London Services can be accessed through IME London website or through IME London’s Customer Service. The signup process requires Customer to provide necessary details and accept these Terms and Conditions. In case Customer orders additional services from IME London, Customer will may request to accept additional terms and conditions, related to that particular service.
5.2. All information provided during the signup process or during the Account management must be accurate and correct.
5.3. For the verification of Customer’s identity, Customer is obliged to present listed below:
5.3.1. A government issued picture ID (e.g. driver’s license, passport)
5.3.2. A utility bill (e.g. electricity, gas or water, but not mobile phone) showing proof of address
6. IME London Services maintenance and safety
6.1. Customer must ensure that all information provided on IME London Services is accurate and up to date. We may contact Customer by e-mail, phone or Customer Agents regarding the account operations. It is Customer’s responsibility to read these messages.
6.2. Customer has access to all transactions made in IME London Servicesthrough the customer portal, which can be accessed through https://www.imelondon.co.uk by entering the registered contact information and the unique password assigned to the Customer.
6.3. Along with transactions processed, all fees charged are also shown in the customer portal. Customer should regularly check IME London Services balance and transaction statement and report to our Customer Service any irregularities or clarification Customer may require.
6.4. In case Customer claims a refund for an unauthorised transaction or incorrectly executed transfer on IME London Services, Customer must notify IME London as soon as they become aware of the situation and no later than thirteen months from the date of the transaction.
6.5. Customer is responsible to take any reasonable steps in order to keep IME London Services login details safe and never disclose them to anyone. We will never ask from Customer to provide us with login details. Customers should consider to change their password regularly in order to reduce the risk of a security breach.
6.6. In case Customer suspects that login details have been lost or stolen, they should immediately contact IME London’s Customer Service and file a report. IME London reserves the right to suspend or limit some functionalities of Customer’s IME London Services in case it is suspected that any security features to IME London Services has been compromised. In this case, IME London will inform Customer about this restriction or suspension as soon as possible. It is advisable to change passwords regularly (at least every three (3) to six (6) months) in order to reduce the risk of a security breach in relation to IME London Services.
6.7. IME London may suspend Customer’s IME London Services or otherwise restrict its functionality on reasonable grounds relating to the security of the IME London Services or any of its security features or if we reasonably suspect that an unauthorised or fraudulent use of IME London Services has occurred or that any of its security features have been compromised.
7. IME London Services closure
7.1. Customer has the right to request closing theirIME London Services anytime. In order to do so Customer must contact IME LondonCustomer Service.
7.2. If Customer’s IME London Services shows a positive balance at the time of its closure, we will arrange funds to be transferred to an external account. This external account’s account holder name must be as per Customer’s IME London Services holder name.
7.3. IME London reserve the right to carry out any necessary money laundering, terrorism financing, fraud or other illegal activity checks before authorising any withdrawal of Customer’s funds, including in relation to returning any funds to Customer after it has closed the IME London Services.
8. Receiving funds to IME London Services
8.1. Customer can transfer funds either paying in card or bank transfer from their own card/bank account only.IME London will only accept funds received from the Customer, thus excluding third party payments. In order IME London to facilitate the transfer, Customer must state the reference code as the Description of the transfer.
8.2. Limits for received funds are defined depending on Customer’s Account Type. Please consider the section“IME London Services Types” of these Terms and Conditions for more details.
8.3. Receiving of funds are subject to fees. Please refer to section“IME London Fees” of these Terms and Conditions for more details.
8.4. IME London reserve the right to carry out any necessary money laundering, terrorism financing, fraud or other illegal activity checks before authorising the transaction and crediting funds to Customer’s account.
9. Sending funds from IME London Services
9.1. Customer will be asked to provide details of the recipient in order to initiate the transfer of funds. Customer must take great care to properly type the exact details of who it wishes to send money to. All information Customer provide may be disregarded and IME London shall not be liable for any error Customer makes when entering the recipient’s details.
9.2. Sending funds from IME London Services is subject to fees and limits. Please consider the section“IME London Fees” of these Terms and Conditions for more details.
9.3. Recipients of Customer’s transfers must be in compliance with any applicable laws and regulation. It is Customer’s responsibility to ensure the appropriate level of controls and ensure the compliance of the transaction. In case of doubt, the payment request should not be processed.
9.4. IME London reserve the right to carry out any necessary money laundering, terrorism financing, fraud or other illegal activity checks before authorising the transaction and transferring funds from Customer’s account.
10. IME London restricted transactions
10.1. Customer will not be able to send funds to the following countries: Afghanistan, Bulgaria, Serbia, Burma/Myanmar, Belarus, Cote d’Ivoire (Ivory Coast), Cuba, Democratic Republic of the Congo, Iran, Iraq, Lebanon, Liberia, Libya, North Korea, Somalia, Sudan, Syria, Ukraine, Yemen and Zimbabwe. Please contact us to discuss service availability in your country of choice; for reference, theIME London website has the lates Terms and Conditions. In addition to the above listed countries IME London reserves the right to request Customer with additional information and supporting documentation related to a transfer request. In addition, IME London may suspend and cancel a transaction in case we reasonably believe to do so for the prevention of financial crime.
10.2. IME London reserves the right to suspend or terminate Customer’s IME London Services at any time if we reasonably believe to be required to do so by law or in order to comply with recommendations issued by a relevant government authority or recognised body for the prevention of financial crime.
10.4. If Customer attempts or conduct any transaction in violation of the prohibited transactions mentioned in these Terms and Condition, we will reserve the right to: suspend and/or close Customer’s IME London Services, reverse any relative transactions and/or report the transaction to the relevant law enforcement agency.
10.5. Recipients of Customer’s transfers must be in compliance with any applicable laws and regulation. It is Customer’s responsibility to ensure the appropriate level of controls and ensure the compliance of the transaction. In case of doubt, the payment request should not be processed.
11. IME London fees
11.1. Full list of IME London fees for the Customer are shown as per below table:

11.2. Transactional fees are subject to change as per section “Changing these Terms and Conditions” of these Terms and Conditions.
11.3. Fees will be deducted from Customer’s IME London Services. If a transaction fee applies, it will be debited from Customer’s IME London Services as soon as the transaction is executed. In case no sufficient funds are available, the transaction will be refused.
12. IME LondonTransaction Limits
12.1. Transaction limits for receiving and sending funds are set as per client, based on individual profiles, please query permitted limits before you execute a transaction.
13. IME London regulating Customer data
13.2. You explicitly consent to IME London accessing, processing, and retaining any information you provide to us, for the purposes of providing payment services to you. This does not affect our respective rights and obligations under data protection legislation. You may withdraw this consent by closing your IME London Services. If you withdraw consent in this way, we will cease using your data for this purpose, but may continue to process your data for other purposes where we have other lawful grounds to do so, such as where we are legally required to keep records of transactions.
14. IME London liability
14.1. We will refund the payment amount and all deducted fees in case on an unauthorised or an incorrectly executed payment due to an error by our side. This does not apply in the following situations:
14.1.1. If the unauthorised payment is a result of your failure to keep your IME London Services login details secure.
14.1.2. If you do not notify us in a reasonable time after you have gained knowledge about any loss of your IME London Services login details or any other situation occurred that may prejudice your IME London Services security. In this situation you will be liable for losses incurred up to your notification to us;
14.1.3. If you compromise the security of your IME London Services with intent or gross negligence and from this behaviour an unauthorised transaction is processed, you are to be considered solely liable for all losses;
14.1.4. If you do not inform us or bring to our attention an unauthorised or incorrect transaction by 13 months from the transaction date, you will solely liable for all losses.
14.2. If you notify and after this notification an unauthorised or incorrect transaction occurs, we shall remain liable and refund the amount immediately to you.
14.3. In case our service or our intermediary services are disrupted, we shall not be liable if the disruption is related to unforeseeable circumstances beyond our reasonable control.
14.4. IME London asks you to constantly check your IME London Services messages and contact our Customer Service in case of doubts or concerns.
14.5. IME London will assist you in case of any incorrect payment and we will take any reasonable measures to assist you with tracing and recovering such payment.
14.6. IME London shall not be responsible for any losses connected to our compliance with legal and regulatory requirements and we shall not be liable for any indirect or consequential losses as loss of profit, loss of business and loss of reputation.
14.7. IME London is to be consider obliged under these Terms and Conditions only in relation to providing money transfer services and ancillary foreign exchange services.
14.8. You will be liable to compensate and reimburse us in case we incur or suffer from you breach of these Terms and Conditions.
14.9. We shall not be liable for the assessment or payment of any taxes, duties or other charges that arise from the underlying commercial transaction between you and another IME London customer.
15. IME London Services terminations and suspension
15.1. IME London may terminate your IME London Services upon giving not less than two months written termination notice. Any of your pending transaction will continue to be governed by these Terms and Conditions until completion. You may terminate your IME London Services with us at any time.
15.2. The termination notice will be provided with instructions on how, remaining funds, will be send to you.
15.3. IME London reserves the right to suspend your IME London Services in the following cases:
15.3.1. For security reasons and if we suspect that your IME London Services has been somehow compromised;
15.3.2. In case we believe or suspect that your IME London Services has been used without your knowledge or fraudulently. In this case we will notify you before process the Account suspension. If prior notification is not possible, we will inform you as soon as possible after suspension unless such notification is prohibited by law.
15.4. IME London reserves the right to terminate your IME London Services with no notice in the following cases:
15.4.1. If any conditions indicated in these Terms and Conditions is breached by you;
15.4.2. If we believe or we have proof that you are in violation of any law or regulation applicable to the use of our services;
15.4.3. If we believe or we have proof that you are involved in any way in a fraudulent activity, money laundering or other criminal activity.
16. Changing these Terms and Conditions
16.1. IME London reserves the right to apply changes to these Terms and Conditions. These changes will be notified to you as per procedures indicated in this section.
16.2. Notification of any changes will be made by email to the email address registered with your IME London Services.
16.3. All changes will become into effect two months after the date of the change notice. If changes make these Terms and Conditions more favourable for you, may come into effect immediately if the change notice indicates so.
16.4. You may give us notice in case you object to the proposed changes before the changes come into effect. In this case the changes will not apply to you and your notice will constitute your wish to close your IME London Services. Your Account will be therefore closed.
16.5. You can anytime request us a most update copy of these Terms and Conditions and any other documents by contacting our Customer Service.
17. IME London communications to you
17.1. IME London usually communicates to you by email. We require you to keep your email address update in your IME London Services and we require you to regularly check your incoming message. You are required to keep copies of all communications we send or make available to you.
17.2. If you are unsure whether a communication sent to you by us is genuine, contact our Customer Service.
17.3. IME London communications are in English and we will accept communication from you only in English. We may provide you with documents and communications in other languages but these shall not be considered as an obligation to us to proceed all communications in that language.
17.4. IME London, along with emails, reserves the right to contact you by telephone or letter.
17.5. If you wish to contact our Customer Service you may do so using the email address firstname.lastname@example.org.
18.1. If you wish to make a complaint about any aspect of IME London Services, you may your complaint in writing to:Pentax House , South Harrow, London. HA2 0DU , or send an email to our Customer Service email@example.com
18.2. We will acknowledge receipt of your complaint within 2 business days by email. The complaint will be recorded on our system and we will investigate your complaint and come back to you with the results of our investigation no later than thirty business days of receipt of your complaint.
18.3. If you are not satisfied with the manner in which IME London has dealt with your complaint, then you may refer to the matter to the Financial Ombudsman Service, Exchange Tower, London E14 9SR, Telephone no. 0800 0234 567, email: firstname.lastname@example.org
19.1. These Terms and Conditions assign right to you only, as IME London Services holder, no other person shall have any rights under these Terms and Conditions.
19.2. IME London Services is operated in the United Kingdom and governed in accordance with the laws of England and Wales. In case of dispute, this shall be exclusively brought in the courts of England and Wales, except where prohibited by the EU law.
